Is BDSM legal in Germany? When can BDSM practices be legally permissible, and where are the limits? This 60-minute talk provides an introduction to the German legal framework surrounding BDSM, with a particular focus on German criminal law. We will look at different BDSM practices, consent and its legal limits, documentation, and what to do when something goes wrong. The talk is specifically about German law and is aimed at an international audience who want to understand how BDSM is treated under the German legal system. What should be discussed before a scene, and what can or should be documented? How does German criminal law deal with practices such as hitting or choking? What role do consent, meta-consent and CNC play? What happens when an act takes place without consent? And what should you do if you are accused of a criminal offense following a BDSM session? Topics covered BDSM Practices and Criminal Liability under German Law What are we actually doing, and which BDSM practices can have criminal-law implications in Germany? BDSM, Consent and German Law When can BDSM activities be legally permissible? What does consent mean in the context of German criminal law? Legal Protection and Documentation What should be discussed before a scene? What can be documented, how, and what can such documentation actually achieve under German law? When Something Happens Without Consent and when Things Don't Go as Planned What can you do if something happens without your consent or goes beyond the agreed boundaries? What are the legal options and practical steps to consider?What happens if the police become involved or a criminal investigation is initiated after a BDSM session? He advises BDSM and sex-work projects throughout Germany and regularly deals with legal questions relating to BDSM practices. As a criminal defense lawyer, he has also represented clients in criminal investigations following BDSM sessions. November 2026, von 18.30 - ca. 20:30 Uhr / ca. 90 Minuten mit Pause  BDSM und das Gesetz - ein Dauerthema in der Szene. Ist BDSM erlaubt? Wann ist BDSM erlaubt und was ist eigentlich erlaubt? In diesem Workshop geht es um alle Fragen rund um BDSM und Strafrecht, Spielarten, Grenzen und Risken. Was muss besprochen werden und wie, damit SM Handlungen erlaubt sind, wie sollten man das dokumentieren und wie ist das in der Session? Wann darf ich jemanden Schlagen oder sogar würgen? Und was darf ich nicht? Was ist mit Konsens, Metakonsens und geht eigentlich CNC? Was passiert wenn etwas ohne Einwilligung geschieht und was sollte ich tun, wenn mir so etwas passiert ist? Was tue ich, wenn mir vorgeworfen wird mich strafbar gemacht zu haben?    1. BDSM - Spielarten und Strafbarkeit: Was tun wir eigentlich? 2. BDSM - Spielarten und Einwilligung: Wann ist SM erlaubt? 3. BDSM - Consent, Konsens, Metakonsens: Was zählt am Ende? 4. BDSM - Rechtssicherheit: Was, wann, wo und wie dokumentieren! 5. Wenn etwas passiert, was nicht passieren darf: Was tun bei Handlungen ohne Einwilligung 6. Wenn es anders kommt, als geplant: Was tun bei strafrechtlichen Ermittlungen  Über den Workshop Leiter:  Ein Volljurist der bereits seit vielen Jahren als Rechtsanwalt und Strafverteidiger in Berlin arbeitet. Unter anderem berät er bundesweit Projekte im Bereich BDSM und Sexwork. In seiner täglichen Arbeit wird er immer wieder mit Rechtsfragen im Zusammenhang mit BDSM Spielarten konfrontiert und hat als Strafverteidiger Ermittlungsverfahren nach BDSM Sessions betreut.
